This website, exploreone.lk (the “Website”), is operated by ExploreOne (Pvt) Ltd (“ExploreOne”, “we”, “us” or “our”), a private limited liability company incorporated in Sri Lanka under the Companies Act, No. 7 of 2007, with company registration number PV00252190 and its registered office at 669, Jana Jaya City, Rajagiriya, Sri Jayawardanapura Kotte 10100, Sri Lanka.
By accessing or using the Website, you agree to be bound by these Terms & Conditions (the “Terms”), together with our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Website.
If you use the Website on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.
02Using the Website
You may use the Website for lawful purposes only. You must not:
- use the Website in any way that breaches any applicable law or regulation in Sri Lanka or elsewhere, including the Computer Crimes Act, No. 24 of 2007;
- attempt to gain unauthorised access to the Website, its servers or any connected system or network, or probe, scan or test their vulnerability without our prior written permission;
- introduce viruses, malware or other harmful material, or carry out any denial-of-service or similar attack;
- copy, scrape, frame or systematically extract content from the Website by automated means without our written consent;
- impersonate any person, or misrepresent your identity or your affiliation with any person or organisation;
- submit false, misleading or unlawful information through our enquiry forms or other channels.
We may suspend or restrict access to all or part of the Website at any time without notice, for example for maintenance or security reasons.
Responsible disclosure. If you believe you have found a security vulnerability on the Website, please report it to info@exploreone.lk and do not test or exploit it further. We will investigate every good-faith report.
03Our services
The Website describes the services we offer, including custom software development, mobile application development, website development, firewall and network security integration, networking and IT infrastructure, and ongoing support and annual maintenance contracts (AMC) (together, the “Services”).
Information on the Website is provided for general information only and is not an offer capable of acceptance. Every engagement is governed by a separate written proposal, quotation, statement of work, service agreement or AMC that has been signed or accepted by both parties (an “Agreement”).
If there is any conflict between these Terms and an Agreement, the Agreement prevails in relation to the Services it covers. Descriptions of features, technologies, timelines and outcomes on the Website are illustrative; the scope, deliverables, service levels, fees and responsibilities for your project will be set out in your Agreement.
04Enquiries and quotations
- Submitting an enquiry through the Website, by email or by phone does not create a contract or oblige either party to proceed.
- Unless stated otherwise, quotations are valid for 30 days from the date of issue. They are based on the information you provide and may be revised if the scope or requirements change.
- Prices for third-party hardware, software licences and subscriptions may change because of exchange rates, supplier pricing, import duties or taxes. We will confirm final prices before you place an order.
- Unless stated otherwise, fees are quoted in Sri Lankan Rupees (LKR) and exclude applicable taxes, which will be added at the prevailing rate.
05Intellectual property
The Website and its content, including text, graphics, page layouts, images, code, the ExploreOne name and logo, are owned by or licensed to ExploreOne and are protected by the Intellectual Property Act, No. 36 of 2003 and applicable international laws.
You may view and print pages from the Website for your own personal or internal business reference. You must not otherwise reproduce, modify, distribute, republish or commercially exploit any content without our prior written permission.
Ownership of, and rights to use, software, designs and other deliverables we create for clients are set out in the relevant Agreement. Nothing on the Website transfers any intellectual property rights to you.
Third-party names, logos and trademarks that appear on the Website, such as technology platforms we work with, belong to their respective owners and are used for identification only. Their use does not imply endorsement or partnership unless we state so expressly.
06Third-party products and links
Many solutions we deliver include third-party hardware, software, cloud services and licences, such as firewall appliances, network equipment and security subscriptions. These are supplied subject to the manufacturer’s or provider’s own terms, licence conditions and warranties, which we will pass on to you where we are able to do so.
The Website may contain links to websites operated by others. We do not control, and are not responsible for, their content, availability, security or privacy practices. You use them at your own risk.
07Disclaimers
We make reasonable efforts to keep the Website accurate, available and secure, but it is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or representations, express or implied, that the Website will be uninterrupted, error-free or free of harmful components, or that its content is complete, accurate or up to date.
Technical, security and networking information on the Website is general in nature and is not professional advice for your specific systems. You should obtain advice tailored to your environment before acting on it.
08Limitation of liability
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of Sri Lanka, including liability for fraud or fraudulent misrepresentation.
Subject to the paragraph above, ExploreOne will not be liable, whether in contract, delict or tort (including negligence) or otherwise, for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, business, goodwill, data or anticipated savings, arising out of or in connection with your use of, or inability to use, the Website or any content on it.
Our liability in connection with the Services is governed exclusively by the terms and limitations set out in the relevant Agreement.
09Indemnity
You agree to indemnify ExploreOne and its directors, employees and agents against any claims, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website.
10Privacy and cookies
Our Privacy Policy explains how we collect, use and protect personal data, and your rights under the Personal Data Protection Act, No. 9 of 2022. Our Cookie Policy explains how we use cookies and similar technologies on the Website.
11Electronic communications
When you visit the Website or contact us electronically, you agree to receive communications from us electronically. You agree that notices and other communications we provide electronically satisfy any legal requirement for them to be in writing, as recognised by the Electronic Transactions Act, No. 19 of 2006.
12Changes to the Website and these Terms
We may update the Website and these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date and apply from the date they are posted. If you continue to use the Website after that date, you accept the updated Terms.
13Governing law and disputes
These Terms, and any dispute or claim arising out of or in connection with them or the Website, are governed by the laws of the Democratic Socialist Republic of Sri Lanka.
We will first try to resolve any dispute amicably through good-faith discussion. If a dispute cannot be resolved within 30 days of either party notifying the other, the courts of Colombo, Sri Lanka will have exclusive jurisdiction.
14General
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
- If we do not enforce any right under these Terms, that does not mean we have waived it.
- You may not transfer your rights under these Terms. We may transfer ours to a successor or affiliated company.
- These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and us about your use of the Website.
